for everyone, it is, afterall, in our best interest.
As with any other place people gather, there are rules.
The following explains the rules that serve as the TERMS
AND CONDITIONS FOR USE OF Access Solutions Internet
Service. If you have any questions about any part of
this agreement, please send us an e-mail about it!
By subscribing to and using Access Solutions (hereinafter
"ASU") ISP services, you acknowledge and agree
to the following:
(1) You are responsible for your actions on the internet
and anywhere else you access through our system. You
explicitly acknowledge that ASU is in no way responsible
or accountable for anything you do while logged into
our system.
(2) As a subscriber you should understand that neither
ASU nor any of the parties who supply information to
the system make any warranty concerning the accuracy
of any information found on or exchanged through the
system.
(3) Your e-mail is considered private. We will look
at your e-mail only if so directed by you or we believe
it is necessary to protect ourselves or other users
from injury or damage. If we have reason to believe
your e-mail is connected with any unlawful activity
we will examine it and disclose it to the proper authorities.
We will never monitor e-mail unless we believe it is
being misused or is connected with illegal activity.
(4) You agree not to send mass unsolicited e-mailings
(SPAM) to users of our system or any other system anywhere
on the Internet.
(5) You agree not to use the system for anything that
is knowingly unlawful.
(6) You agree that while connected to the internet
through our system, you will not run any unattended
process or server, including but not limited to ftp
servers, web servers, IRC servers, MUDs, etc.
(7) You agree not to try to gain entry to any areas
of our system not specifically assigned to you. You
agree not to try to gain entry to the system areas of
our computer system, to the areas reserved for other
users, or to any computer system accessible on the internet
through our system.
(8) Any person who actively disrupts system function
will be financially liable for system administration
costs to repair the damage.
(9) Credit Card Customers: Your credit card may be
billed monthly for the invoiced price. If payment is
refused, you will have seven (7) days to arrange for
payment, after which your account will be locked. Also,
ASU will not be held responsible for credit card payments
or bank drafts charged through arranged monthly billing
if you fail to notify us in writing of your decision
to cancel.
(10) Account Customers: ASU reserves the right to cancel
a subscribers membership at any time for reasons including
but not limited to the following: non-payment of account,
simultaneous usage on Family, Student or Business Plan
One accounts, and Returned Checks for payment on account.
Cancellation Policy
For your protection, ASU requires a written notice
of cancellation via e-mail, postal mail, or in person
stating your request to cancel and the date you would
like your service to end.
If you do not cancel your account in this way you
will be responsible for continuous fees on your account.
You will be responsible for the full month of service
if you have not cancelled prior to the last day of
that service. (If you cancel September 1 you will
be fully responsible for Septembers fees and your
account will remain open until September 30).
If you desire to remain active through a certain
date, please inform us of that date or your service
will be cancelled immediately.
Refund Policy
Refunds are at the sole discretion of ASU and will
be based on the following reasons: 1. You have moved
to an area where ASU does not provide service, therefore
causing you to find a new service provider. 2. You
or the person using the Internet has become terminally
ill or unable physically or mentally to use any Internet
Service Provider. 3. Your service is not working and
we are unable to offer a reasonable solution or compensation.
4. ASU is unable to provide you service due to incompatibility
or other reasons based on our discretion.
PLEASE NOTE: UNLESS THE ABOVE ITEMS APPLY, WE DO
NOT PROVIDE REFUNDS FOR THOSE CHOOSING ANOTHER PROVIDER
BASED UPON THEIR OWN REASONS AND CHOICES.
Refunds are processed as follows: 1.Monthly Accounts
may be issued a refund of 1 month depending upon the
issue surrounding the refund. 2. Annual and Quarterly
Accounts can be issued a refund based on the standard
rate for their plan minus the discount they received
for paying in advance and a $20.00 Deactivation Fee.
3. Credit Card Refunds: Credit Card refunds will be
sent to you by check unless all parties agree that
it is our error that we processed your card. 4. There
are no refunds given on Account Set Up Fees. 5. All
refunds are done by check and will be processed within
20 business days.
